TreeTribe Terms of Use

1. Acceptance of Terms

By downloading, installing, or using TreeTribe (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App, regardless of the platform (Android or iOS) used to access it.

2. Description of the App

The app is intended for informational purposes only. It is not intended to be a substitute for professional advice, consultation, supervision, diagnosis, treatment, medical treatment, psychotherapy, counselling, or mental health services. Use of the TreeTribe app and any resource linked to it does not create a therapeutic, counselling, or professional relationship between the user and Hettie Brittz Coaching or any associated resources. Do not rely upon information on the app for treatment purposes.

The App is provided by Hettie Brittz Coaching (“we”, “us”, or “our”). It allows users to register, manage their account, and interact with associated services. The App integrates with a WordPress-based backend system to create or update user accounts and profiles.

3. Eligibility

By using the App, you represent and warrant that:

  • You are at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
  • You have the legal capacity to enter into a binding agreement
  • Your use of the App does not violate any applicable law or regulation

4. User Accounts and Registration

To use certain features of the App, you must provide your first name and surname, email address, and contact number. This information is used to create or update your account on our WordPress platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as necessary.

5. WordPress Account Integration

The App creates or updates a corresponding account on our WordPress-based platform using the information you provide. By using the App, you consent to:

  • The creation of a WordPress account on your behalf if one does not already exist
  • The update of your existing WordPress account data to reflect information entered in the App
  • The synchronisation of your profile data between the App and the WordPress platform

6. Acceptable Use

You agree not to use the App to:

  • Attempt to diagnose, treat, counsel, coach, assess, or measure abilities of any individual without professional qualification
  • Misrepresent its tools as a psychological or relational device in lieu of professional care
  • Discriminate based on any person’s Tree Trait List results in the delivery of services, provision of opportunities, employment, or access to resources
  • Violate any applicable local, national, or international law or regulation
  • Transmit any unauthorised or unsolicited advertising or promotional material
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the App or its related systems
  • Attempt to gain unauthorised access to any part of the App, its servers, or related systems
  • Copy, adapt, stream, display to a group, mine, or distribute the content to circumvent the intended use of the app by individuals only after downloading it onto their personal device(s)
  • Collect and enter into the app personal information of children under 13 years of age, except for information of your own children’s names and ages for Tree Type trait list completion

7. Intellectual Property

All content, branding, design, and software within the App — including all Tree Type terminology, Trait lists, trademarks, algorithms, trait list results, trait descriptions for each Tree Type, and all content on associated landing pages — is the property of Hettie Brittz Coaching or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Your access to or use of the App does not grant you any right or licence to use any logos, terminology, or trademarks, or to claim expertise or permission to use any of the above in the rendering of services to clients of any kind.

8. Analytics and Tracking

The App uses third-party analytics tools to collect non-identifiable usage data, such as feature interactions, session duration, and crash reports. This data is used solely to improve the App’s performance and user experience. For more information, please refer to our Privacy Policy.

9. Third-Party Services

The App may integrate with or link to third-party services (including analytics providers and the WordPress platform). We are not responsible for the privacy practices or content of those third-party services. Your use of such services is governed by their respective terms and policies.

10. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. Although the App contains content regarding traits and behaviour, it is in no way a medical, psychological, psychometric, therapeutic, diagnostic, or treatment tool.

11. Limitation of Liability

By downloading this App, the user agrees to indemnify, defend, and hold harmless Hettie Brittz Coaching, its affiliates, and their respective directors, licensors, officers, employees, and agents from and against all claims, losses, indirect, incidental, special, consequential, or punitive damages, fines, and expenses, including attorneys’ fees and costs, arising directly or indirectly out of or in connection with the use of the App, to the fullest extent permitted by applicable law. Each user accepts full responsibility for their use, interpretation, and application of the content on the App.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

13. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this document or by in-app notification. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms.

14. Alteration and Termination

Hettie Brittz Coaching and its licensors shall have the right at any time to change or discontinue any aspect or feature of the App, including but not limited to content, availability, and equipment needed for access or use. We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
